CFTC Penalizes Cost Management Solutions $100,000 for Operating as Unregistered Introducing Broker

The Commodity Futures Trading Commission (CFTC) has issued an order filing and settling charges against Cost Management Solutions, LLC (CMS), a Texas-based company, for operating as an unregistered Introducing Broker (IB).
Under the order, CMS must pay a $100,000 civil monetary penalty and cease and desist from further violations of the Commodity Exchange Act (CEA).
According to CFTC findings, CMS acted as an unregistered IB from at least May 2018 through the present. The firm solicited and accepted client orders for swap and options transactions primarily in energy commodities, including propane, heating oil, and crude oil. Most of the firm's clients were propane retailers looking to hedge commercial risks.
CMS performed brokerage functions such as identifying counterparties, facilitating price discovery, negotiating trade terms, and executing swap or options transactions on behalf of its clients in exchange for brokerage fees. While CMS did not accept margin, guarantee, or security funds directly, its core operations required legal registration as an Introducing Broker under federal commodity trading laws.
The regulatory agency strongly urges market participants and investors to confirm whether a company or individual is registered with the CFTC before committing funds or engaging in transactions. Registration status can be verified using the National Futures Association (NFA) BASIC database. Working with unregistered entities exposes market participants to heightened counterparty and regulatory risks. Suspicious activities or potential violations can be reported directly to the CFTC Division of Enforcement.
