CFTC Warns Regulated Markets Against Misleading Pricing Formats for Event Contracts
The CFTC has cautioned regulated entities against using gambling-style odds formats for event contracts, emphasizing compliance with federal anti-manipulation laws.
The Commodity Futures Trading Commission (CFTC) has issued a formal reminder to market participants regarding the requirement to display clear and accurate pricing information for derivatives products, with a specific focus on event contracts.
Issued jointly by the CFTC’s Division of Market Oversight and Market Participants Division, the staff advisory directs registered entities involved in listing, soliciting, or accepting event contracts to uphold transparency standards and prevent misleading consumers. The regulator underscored that this responsibility includes rigorous oversight of intermediary market participants, corporate affiliates, and operating partners.
Staff specifically warned market operators against displaying contract pricing using the "American" odds format commonly utilized by casino sportsbooks and gambling bookmakers. The CFTC stated that this convention is likely to confuse market participants about the nature of the transaction and can obscure market depth as well as pricing impact.
Under regulatory standards, market participants must provide pricing and transaction details that clearly demonstrate when a product is an exchange-traded event contract on a CFTC-regulated market, rather than a higher-margin, non-market-priced bookmaking service.
The divisions reminded all regulated entities and persons that presenting misleading pricing information in connection with any regulated product creates exposure to violations of federal law prohibiting manipulative devices.
