The Commodity Futures Trading Commission (CFTC) has launched a new regulatory initiative designed to enable the trading of spot cryptocurrency asset contracts on CFTC-registered futures exchanges, known as designated contract markets (DCMs). Announced by CFTC Acting Chairman Caroline D. Pham, the move represents the first formal step in the agency's "crypto sprint" aimed at executing recommendations outlined in the President's Working Group on Digital Asset Markets report. The initiative is being conducted in coordination with the Securities and Exchange Commission's (SEC) "Project Crypto." Under the Commodity Exchange Act (CEA), retail commodity transactions that involve leverage, margin, or financing arrangements are generally required to be executed on a registered DCM. The CFTC plans to utilize this existing statutory authority to establish regulatory clarity for listing spot digital asset contracts on federal exchanges. As part of this effort, the regulator is seeking feedback from market participants and the public on operational and regulatory considerations under section 2(c)(2)(D) of the CEA and Part 40 of CFTC regulations. The consultation also invites commentary on potential touchpoints with federal securities laws, including an SEC framework governing the trading of non-security assets associated with investment contracts. Market stakeholders and members of the public have been invited to submit written comments through the CFTC website by the deadline of August 18. All submitted feedback will be made publicly available on the agency's official platform.
