CFTC Issues Staff Interpretative Letter on Specific Foreign Exchange Transactions
The CFTC's Market Participants Division and Division of Market Oversight have released guidance clarifying the classification of specific FX transactions under the Commodity Exchange Act.
The Commodity Futures Trading Commission (CFTC) announced that its Market Participants Division and Division of Market Oversight have issued an interpretative letter addressing the classification of certain foreign exchange (FX) transactions under the Commodity Exchange Act (CEA).
The joint staff letter provides the divisions' views on whether specific transaction types are characterized as swaps, foreign exchange forwards, or foreign exchange swaps as defined within the CEA framework.
According to the interpretative guidance, Window FX Forwards, as described in the letter, should be treated as "foreign exchange forwards."
Furthermore, the divisions determined that Package FX Spot Transactions, as outlined in the letter, should not be considered "foreign exchange swaps" or "swaps."
