The CFTC's Division of Clearing and Risk has withdrawn Staff Advisory No. 23-07 to ensure uniform regulatory treatment across digital asset derivatives and other cleared products.

CFTC Division of Clearing and Risk Withdraws Advisory on Digital Asset Clearing
The Commodity Futures Trading Commission's (CFTC) Division of Clearing and Risk (DCR) has announced the immediate withdrawal of CFTC Staff Advisory No. 23-07, titled "Review of Risks Associated with Expansion of DCO Clearing of Digital Assets." According to the regulatory announcement issued on March 28, 2025, DCR determined to withdraw the advisory to ensure that its regulatory treatment of digital asset derivatives does not suggest any divergence from its oversight of other asset classes and derivatives products. Staff Advisory No. 23-07 previously highlighted staff expectations and risk-management considerations for Derivatives Clearing Organizations (DCOs) seeking to expand clearing operations into digital asset derivatives. The withdrawal aligns the division's formal posture, treating digital asset derivatives consistently within the broader regulatory framework governing clearinghouses.
