CFTC Appoints David I. Miller as Director of Enforcement

The Commodity Futures Trading Commission (CFTC) has appointed former federal prosecutor and white-collar defense attorney David I. Miller as its new Director of Enforcement, agency Chairman Michael S. Selig announced. Miller assumes leadership of the CFTC's enforcement division following decades of legal experience in both public service and private practice. According to Chairman Selig, Miller will focus the division on its core statutory purpose of policing fraud, abuse, and market manipulation. Chairman Selig also acknowledged Paul Hayeck, who had been serving as acting director of enforcement since June 2025. Hayeck will remain at the agency to serve as chief of the Enforcement Division's Complex Fraud Task Force, leading investigations into complex fraud, abusive trading practices, and market manipulation. Miller joins the regulator from private practice, where he was a litigation partner at law firms Greenberg Traurig and Morgan Lewis. His legal practice concentrated on white-collar defense, internal and government investigations, commodities and securities enforcement, digital asset regulatory issues, and complex civil litigation, representing clients before the CFTC, the Securities and Exchange Commission, the Department of Justice, and self-regulatory organizations. Prior to his time in private practice, Miller spent nearly a decade in government service, including five years as an assistant U.S. attorney in the Southern District of New York as part of the Securities and Commodities Fraud Task Force. He also previously worked as a Department of Justice terrorism prosecutor, a special assistant U.S. attorney in the Eastern District of Virginia, and an assistant general counsel for the CIA. Miller holds a law degree from the New York University School of Law and an undergraduate degree from Georgetown University.
